Agreement to Receive Text Messages
By providing your mobile telephone number and affirmatively opting into any SMS or MMS messaging program offered by Matterhorn Tax Planning Inc. (“Matterhorn Tax Planning,” “Company,” “we,” “our,” or “us”), you expressly consent to receive recurring automated and/or non-automated text messages at the mobile telephone number provided.
Messages may include consultation confirmations, appointment reminders, responses to inquiries, tax planning information, educational content, newsletter updates, business announcements, referral communications, service updates, customer support messages, and other communications related to Matterhorn Tax Planning services.
Your consent to receive text messages is voluntary and is not a condition of purchasing any goods or services or receiving information from Matterhorn Tax Planning.
By enrolling in our messaging program, you represent and warrant that you are the authorized subscriber or customary user of the mobile telephone number provided and that you have authority to provide consent to receive communications at that number.
Program Description
Matterhorn Tax Planning operates an SMS messaging program designed to communicate with prospective clients, existing clients, and individuals who request information regarding tax planning resources, consultations, educational materials, and professional referral services.
Messages may include, but are not limited to, consultation scheduling, appointment reminders, follow-up communications, tax planning education, newsletters, updates regarding requested information, referral-related communications, customer support responses, and other communications related to your interaction with Matterhorn Tax Planning.
Matterhorn Tax Planning may also provide information regarding opportunities to connect with independent CPAs, tax attorneys, and other professional service providers. Any professional relationship established with a referred provider is separate from Matterhorn Tax Planning.
Message content and timing may vary depending on your interactions with the Company, communication preferences, requested information, and available content.
Message Frequency
The number of messages you receive will vary depending on your interaction with Matterhorn Tax Planning, your communication preferences, and the services or information requested.
Most subscribers may receive approximately two (2) to eight (8) messages per month; however, message frequency may increase or decrease based on consultation requests, customer inquiries, scheduling needs, or other communications initiated by you.
Message and Data Rates
Message and data rates may apply according to your wireless carrier’s messaging plan.
Matterhorn Tax Planning does not charge a fee to participate in its SMS messaging program; however, your wireless carrier may impose messaging, data, roaming, or other charges.
You are solely responsible for any fees or charges imposed by your mobile carrier.
Opt-In Consent
You may enroll in the Matterhorn Tax Planning messaging program by submitting an online form, requesting a consultation, requesting information through our website, subscribing to communications, providing written consent, or otherwise affirmatively consenting to receive SMS messages.
Your opt-in constitutes your electronic signature and express written consent to receive recurring SMS communications from Matterhorn Tax Planning at the mobile telephone number provided.
By opting in, you acknowledge that automated technology may be used to deliver text messages where permitted by applicable law.
Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP to any text message received from Matterhorn Tax Planning.
After submitting an opt-out request, you may receive one final confirmation message confirming that your request has been processed. No further SMS messages will be sent unless you provide new consent.
Supported opt-out keywords may include STOP, END, CANCEL, QUIT, UNSUBSCRIBE, STOPALL, or STOP ALL where supported by the messaging platform.
Opting out of SMS communications does not prevent Matterhorn Tax Planning from contacting you through other permitted methods, including email, telephone, or communications relating to an existing request, appointment, transaction, or business relationship.

Messaging Technology
Matterhorn Tax Planning may use automated messaging platforms, customer relationship management systems, SMS application programming interfaces (“APIs”), manual messaging tools, and other lawful communication technologies to deliver SMS and MMS communications.
These technologies are used solely to facilitate communications with individuals who have provided the required consent or otherwise requested communication from Matterhorn Tax Planning.
Carrier Disclaimer
Wireless carriers are not responsible for delayed, failed, incomplete, misdirected, or undelivered messages.
Message delivery depends on factors outside of Matterhorn Tax Planning’s control, including wireless carrier networks, mobile device compatibility, signal availability, and other technical limitations.
SMS messaging services may not be available on all carriers, devices, or geographic locations.
Updating Your Mobile Number
If your mobile telephone number changes, is disconnected, or is reassigned, you agree to promptly update your contact information or discontinue enrollment using the previous number.
Matterhorn Tax Planning is not responsible for messages sent to recycled, reassigned, or transferred telephone numbers where you have failed to provide updated contact information.
Consent Records and Compliance
Matterhorn Tax Planning maintains records demonstrating consumer consent in accordance with applicable laws, industry standards, and carrier requirements, including the Telephone Consumer Protection Act (“TCPA”), CTIA guidelines, and messaging provider requirements.
Consent records may include your mobile telephone number, date and time of consent, IP address, browser information, user-agent information, website URL, landing page information, consent language presented at enrollment, confirmation records, communication history, and other information reasonably necessary to demonstrate compliance.
These records may be maintained by Matterhorn Tax Planning or authorized service providers for compliance, auditing, and recordkeeping purposes.
Privacy and Data Use
Your participation in Matterhorn Tax Planning’s SMS messaging program is also governed by our Privacy Policy.
Matterhorn Tax Planning does not sell, rent, lease, or share mobile telephone numbers, SMS consent records, or opt-in information with third parties for their own independent marketing purposes.
Mobile information may be shared only with trusted service providers that assist with SMS delivery, telecommunications services, website operations, customer relationship management, compliance monitoring, customer support, and business administration.
These providers may use information only as necessary to provide services on behalf of Matterhorn Tax Planning and are not permitted to use mobile information for their own marketing purposes.
Program Changes
Matterhorn Tax Planning reserves the right to modify, suspend, or discontinue its SMS messaging program at any time, including changes to message content, frequency, enrollment methods, eligibility requirements, supported keywords, or technical functionality, subject to applicable law.
Disclaimer of Warranties
The SMS messaging program is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory.
Matterhorn Tax Planning does not guarantee uninterrupted, timely, or error-free delivery of text messages and disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, Matterhorn Tax Planning Inc., its affiliates, officers, directors, employees, contractors, agents, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from participation in the SMS messaging program, including damages resulting from delayed, undelivered, duplicate, or misdirected messages.
The Company’s aggregate liability relating to the SMS messaging program shall not exceed one hundred dollars (US $100.00).
Governing Law
These Mobile Messaging Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Changes to These Terms
Matterhorn Tax Planning may revise these Mobile Messaging Terms from time to time.
Updated versions will become effective upon posting to our website unless a later effective date is specified. Your continued participation in the messaging program after revisions become effective constitutes acceptance of the updated Terms.
